Welcome to InsideBox (the "App"), a mobile application developed and operated by TeamKay LLC ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the App, including any content, features, and services provided through it. By accessing or using the App, you agree to be bound by these Terms.

The purpose of these Terms is to establish the rules and guidelines for using the App, including your rights and responsibilities as a user (“you”). We encourage you to read these Terms carefully. If you do not agree with any part of these Terms, please refrain from using the App.

Your continued use of the App constitutes your acceptance of these Terms. If you have any questions or concerns about these Terms, please contact us before using the App.

User Responsibilities

Personal Use Only

This App is intended solely for personal, non-commercial use. We reserve the right to monitor usage patterns to ensure compliance with this restriction. If we detect data volumes or activity levels significantly beyond normal household usage—suggesting possible commercial or other non-personal use—we may temporarily restrict your access to the App while we review our terms and pricing.

Your privacy is important to us. Our Privacy Policy outlines how we collect, use, and protect your personal information when you use the App. By using the App, you agree to the collection and use of information as described in the Privacy Policy. Payment Terms

Subscription and Billing

The App offers access to premium features through a subscription model. The subscription may be available on a monthly, yearly, or other periodic basis, with specific pricing and details provided within the App’s pricing section. By subscribing, you agree to pay the fees associated with the subscription period you select.

No Refund Policy

Except as required by applicable law, all payments for subscriptions are non-refundable. However, if you cancel within 48 hours of your initial subscription, you may be eligible for a full refund processed automatically through the App Store or Google Play Store. After this short grace period, all sales are final, and you will retain access to the premium features until the end of the current billing cycle, even after cancelation.

Subscription Cancelation and Renewal

You may cancel your subscription at any time by accessing your account settings in the App Store or Google Play Store. Canceling a subscription will prevent future billing, but you will retain access to the premium features until the end of the current subscription period.

In the event of a failed renewal (e.g., due to insufficient balance, expired card, or manual cancellation), we will notify you via email. You will be provided with a grace period of 60 days to renew your subscription to retain access to your data stored in the cloud. After 60 days without renewal, your account and associated data may be permanently deleted from our servers. 

Data Retention and Deletion Policy

If your subscription is not renewed within the 60-day grace period, your account and all associated data (including files and other user-generated content) will be permanently deleted. During the grace period, you are encouraged to download your data if you do not plan to renew your subscription. Please note that the report reflects the data stored in the database at the time of generation, so it is your responsibility to request it before the data is deleted.

Updates to Payment Terms

We reserve the right to adjust subscription fees and payment terms. Any changes will be reflected in the App’s pricing section and will apply to future subscription renewals. Current subscribers will not be affected by pricing changes during their active subscription period.

Termination

We reserve the right to terminate or suspend your access to the App if we have a reason to believe you have breached these Terms, or if we have other valid reasons, such as legal requirements or technical issues. In such cases, we may also retain or delete any data associated with your account as permitted or required by applicable laws.

If you wish to terminate your use of the App, you may simply discontinue using the App or choose to delete your account and associated data. For more information on how to delete your account, please refer to the app's settings or contact us at info@teamkapps.com .

Please note that we may terminate the availability of the App or discontinue its support for any reason, including but not limited to financial, technical, or business considerations. In such cases, we will make reasonable efforts to provide you with advance notice and instructions on how to retrieve your data. After the specified period, your data may be deleted or rendered inaccessible. We will ensure that no further subscription renewals are processed; however, any subscription fees already paid are non-refundable. This is due to the complexity of calculating unused portions of the subscription, as the fees are based on average usage and partially allocated to third-party services.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms, or your use of the App, shall be subject to the exclusive jurisdiction of the courts located in California, and you hereby consent to the jurisdiction of such courts.

You are also responsible for complying with any local laws, regulations, and industry standards applicable in your jurisdiction while using the App. In the event of any conflict between the laws of your jurisdiction and the laws of California, United States, the laws of California shall prevail for any disputes related to these Terms.

Dispute Resolution

If any dispute arises between you and TeamKay LLC related to these Terms or your use of the App, we encourage you to first contact us directly to seek an informal resolution. You can reach us at info@teamkapps.com.

If we cannot resolve the dispute informally within a reasonable period, both parties agree to resolve any claims through binding arbitration, as the sole and exclusive remedy, rather than in court. This means you waive your right to a trial by jury or participation in a class-action lawsuit. However, either party may bring claims in small claims court if the dispute qualifies.

Arbitration Process

Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA), and the location for such arbitration will be in California, unless both parties agree otherwise. The arbitration will be conducted in English and administered by a single arbitrator.

Costs and Fees

Each party will bear their own costs, including legal fees, associated with the arbitration unless the arbitrator rules otherwise.

Exceptions

This section does not prevent either party from seeking injunctive relief for intellectual property or security-related claims in a court of competent jurisdiction.

Changes to Terms

We reserve the right to modify or update these Terms at any time. If we make significant changes, we will take reasonable steps to notify you of these updates. For registered users, we may send an email to the address you provided when creating your account. Additionally, the updated Terms will be presented to you through an in-app notification the next time you use the App. It is your responsibility to review the updated Terms. Continued use of the App after being informed of the changes constitutes your acceptance of the modified Terms. If you do not agree with the changes, you should discontinue your use of the App.
